PURPOSE OF THE JOB:

To plan and lead the Regulatory Affairs function by providing responsive general corporate legal advisory support, management of legal issues and providing oversight of litigation and litigious matters, for the attainment of Namport’s strategic objectives. The position serves to support the Chief Legal Advisor and Company Secretary with Regulatory Risk Monitoring and Enforcement functions. The position is at a specialist level of work and reports to the Chief Legal Advisor and Company Secretary.


KEY ACCOUNTABILITIES

  • Provide advice on areas that expose the company’s business interests, considering Namport’s business strategy and environmental scan and research.
  • Provide timely and meticulous legal advice and services to support the control and management of risk.
  • Execute assigned drafting and revising agreements, ensuring contractual certainty, and handling legal documentation meticulously and ethically.
  • Attend assigned court cases with legal practitioners and advocates as required.
  • Assess legal implications of all actions and legislative and regulatory changes affecting the Namibian Ports Authority.
  • Represent the company in assigned conciliation and arbitration of labor matters, as well as commercial arbitrations, legal dispute resolution, and management of litigation matters.
  • Develop, implement, review, and monitor the organization’s Regulatory Monitoring and Enforcement framework, strategy, policy, systems, and processes, ensuring compliance.
  • Ensure continuous monitoring and provide regulatory oversight for any activities outsourced.
  • Act as an advisor to business projects and initiatives related to regulatory and enforcement matters.
  • Create awareness among relevant stakeholders regarding new regulatory requirements or provide guidance on the impact of regulatory changes.
  • Manage the delivery of regulatory reports highlighting monitoring and enforcement activities and any breach instances, within agreed time frames.
  • Ensure sound financial management and administration of assigned cost items in alignment with approved budgetary provisions.
  • Plan, lead, and oversee timely and effective service delivery to the Division’s internal and external clients to enhance customer experience.
  • Coordinate and develop effective working relationships with internal and external stakeholders.
  • Execute assigned Compliance Risk Management projects and assignments.

QUALIFICATIONS & EXPERIENCE

  • A Bachelor or Honours Degree [NQF Level 8] in the field of Law (LLB) or equivalent.
  • Admission as a Legal Practitioner of the High Court of Namibia.
  • A minimum of five (5) years relevant technical experience in Legal Practice, Compliance, and Governance, with at least three (3) years in a supervisory role within a corporate environment.
  • Experience in corporate law and the maritime industry is an advantage.
  • Broad legal knowledge and understanding of legal issues in the maritime industry.
  • Strong analytical, research, and writing skills, with sharp attention to detail.
  • Strong leadership skills, with the ability to work effectively within a team and independently.
  • Excellent negotiation, critical thinking, and persuasion skills, along with the ability to make sound judgments and promptly resolve issues.
  • Exceptional communication skills, both verbal and written, and strong interpersonal skills, with the ability to build effective relationships with stakeholders at all levels.
  • High degree of professionalism, ethics, integrity, and responsibility.
  • Strong capability to handle confidential matters with discretion.
